This research focuses on the right to a fair and reasonable trial in the context of women's property disputes within the Kosovo judicial system. It examines the legal basis for this right and its application in practice.
The study analyzes women's property disputes presented to the basic courts in Kosovo's regional centers, as well as the Appellate Court and the Supreme Court. It is divided into four chapters covering the legal foundation, judicial practices, time reasonableness of case resolutions, and conclusions with recommendations.
The research aims to inform the public about the current state of adherence to the right to a fair trial within a reasonable time. Data is obtained from the European Court of Human Rights' database, the official website of the Judicial Council of Kosovo, and the research platform "Lexdocs." A random selection of the ten most recent completed cases from each basic court branch is analyzed, covering the period from 2009 to 2022.
